We provide an overview of two important changes associated with the use of electronic marketplace for public procurement.

The threshold for procurement obligations through the electronic marketplace has increased to 5 000 euros

The threshold for procurement of readily available goods such as furniture, office supplies and so on. still she lived in the past year set at 1,000 euros, which in practice restricts many authorities. With the amendment of the old and the arrival of the new Public Procurement Act, however, this limit moves up to 5,000 euros. Recalls that the obligation to procure commercially available goods with a value equal to or greater than EUR 5 000 and commercially available services with a value equal to or greater than 20 000 euros through EKS are all contracting authorities, as well as persons who have been granted financial resources of the contracting authority, at least in 50% of the value of the project co-financed by public funds.

This situation changed at the end of last year, when the Ministry of Interior launched a pilot operation of the overflow electronic marketplace, which gives contracting authorities the option (but not the obligation) to implement an overflow purchases through ECS. We recall that limit exceeding contracts are contracts under regulations of the Public Procurement (currently Decree no. 153/2016 Coll.), Whose values ​​are starting at 135,000 euros and 209,000 euros.
